近日浏览国外论坛发现一篇帖子,看过以后不寒而栗!也终于明白了前段时间,很多卖家向我们反映,自己明明是brand owner,图片也是自己拍的,却会收到IP infringement也就是知识产权侵权投诉的真正原因了。
原来,不是版权所有者,也可以投诉,原来亚马逊的这个版权漏洞,竟然也可以变成打击竞争对手的工具,想想真令人后怕,相信侃妹的读者里面应该也有不少小伙伴遭受过类似的情况吧?
大家先不急,为了保证原始资料的完整性,侃妹把原文原封不动的放出来:
So Amazon is such a mess. I have my employees opening anywhere from 150-250 claims a month currently. Some of those claims vary. We open claims through Vendor Express, through Amazon, with pq-preapprovals, seller-performance, notice@amazon.com, copyright@amazon.com, blah blah blah. Some of those claims are tracked in the case log, sometimes we are emailed on them and they do not appear in the case log and sometimes they mark them as answered when they are not and Amazon's system makes those cases a bitch to find.
We have multiple brands in the registry and they both equal more than 100K a month in sales. We have some popular listings so many sellers started copying our pages and making their own with higher prices. If a customer purchased from them they would turn around and order from us. It didn't bother me at first but it got out of hand quick. We asked Amazon to just remove these pages since they are duplicated. They stated they can only merge them - well if you have ever merged a page, it is a mess. They will mess up all the info, images, etc so instead we decided to file copyright claims here. We just pasted the ASINs in and marked the images as infringing. We did this for about 50 listings. Every single one was pulled down within a week. We were told we would be updated but never were - I checked by searching the ASINs and noticed they were completely removed from the catalog.
Amazon shared our information with the sellers that were infringing. One seller ended up emailing me - his account got banned. His English shows he is most likely from India. He also told me how he uses Amazon to support his family. Anyways I don't know if it is right but he apologized so I emailed Amazon to ask that they remove the claim against him. He won't be selling my items again and I honestly feel bad about it. I wanted to share this with you guys because I am extremely surprised how easy it is to file a claim with no proof. I could have just filed a false claim, got this seller banned and then ignored his emails. I have been on the reverse side of this where I received a performance notification on a false claim and I emailed the owner of the IP back and since they never responded there was nothing I could do. So say you have 1 competitor and you hit him with a false claim a week before Thanksgiving - you could most likely have him kicked off Amazon for 3-4 weeks while solving the claim and grab all his sales. Even though I am on the "winning" side of this issue with Amazon the system seems fucked up, doesn't it?

I am extremely surprised how easy it is to file a claim with no proof. I could have just filed a false claim, got this seller banned and then ignored his emails.即使你不是brand owner, copywrite owner,你照样可以投诉别人,不需要提供任何的证据证明,有很大的几率把对手搞掉,而且你只要不回复对方的邮件,对方可能就完全没有上架的机会了。这种行为英文叫做false claim,而且这么做的人也是越来越多了!

这里肯定有人会问,里面有一些栏目需要填什么原贴信息啊这些的怎么办呢?比如这个版权作品的链接,其实很简单的,比如人家盗用的是苹果的图,你去苹果官网图片链接搞过来就行了,你只需要证明这个图不是他的就可以了,并不需要证明这个图是不是你的。甚至这一块也可以伪造,比如弄个自建站,把这些图片挂在某个品牌自建站上面,说这张图有版权也是有很大几率让亚马逊把对方listing下架的。大家可以看看上文这个作者基本上50+listing,全部都干死了,基本上失败率非常之低!
另一种观点
我相信一般人看到这个以后一定会义愤填膺,但是这篇帖子后面的评论却是另一种的观点:
It's exactly the same if you self-publish ebooks for Amazon Kindle. Anyone can file a "copyright claim" against you and Amazon can remove your book(s) and/or ban your account with no notice. Then it's up to you to prove you do own your own copyright. It's scary how easily these systems can be abused by your competition. But the flip side is, it's very easy to get books that steal your content taken down.这些鬼佬的意思就是亚马逊这种机制某种程度上也是对的,因为如果你的确是拥有这个图片的copywrite版权的话,就算别人投诉你,你也可以拿证明拿回来,但是如果你的确侵犯了别人的版权,即使投诉人不是版权所有人,那又有什么关系呢?这不就是另一种模式的监督么?所以这种模式不一定是一个bug,而是亚马逊的一种净化平台的手段,进一步保障知识产权,侃妹仔细想一下,好像是这么一个道理!
但是,鉴于很多中国卖家卖的东西很多都是有侵权风险的,特别是图片或者外观专利这一块,竞争对手就很有可能用这个方法来搞你,不过换句话说,平台的这个机制也可以反过来督促我们卖家朋友们更有知识产权的意识,而不是一味地钻空子卖侵权产品,侃妹是见过专门卖侵权产品的卖家到最后亏得一塌糊涂还要被人上门打的案例的!
